While the primary focus of this treatise is on binding arbitration agreements in the consumer context, arbitration clauses are extensively used to bind employees, medical patients, nursing home residents, and others. This treatise will cite to both consumer and non-consumer court decisions involving arbitration, because the principles that they establish are generally applicable in the consumer setting. For instance, much of the pro-consumer case law relating to prohibitively expensive mandatory arbitration clauses arises from doctrines first articulated in employment law cases.
